These Terms & Conditions (“Terms”) form a legally binding agreement (“Agreement”) between you (“Renter,” “Guest,” or “You”) and ItWhip.com (“We,” “Us,” or “Our”)—and, where applicable, the independent vehicle owner (“Host”). By booking a vehicle through our platform, you agree to all of the terms set forth herein. Please read these Terms carefully before making a reservation.

1. DEFINITIONS.

AGREEMENT,

This Agreement includes all terms and conditions on this document, any attached addenda, and any materials provided at the time of rental. It governs all interactions between Hosts, Guests, and ItWhip.com.

YOU / YOUR:

“You” or “Your” refers to the individual identified as the renter in your booking, any additional person who signs the Agreement, any authorized driver, and any party designated to receive charges at your direction. Every person falling under “You” is jointly and severally bound by these Terms.

WE / OUR / US:

This term refers to ItWhip.com as the online facilitation platform and, where applicable, the Host who manages the rental. ItWhip.com operates as a technology provider connecting Hosts and Guests.

AUTHORIZED DRIVER:

An Authorized Driver is any individual approved by the Host or ItWhip, including you (the Renter) and any additional driver with a valid driver’s license who meets the minimum age and legal requirements of the state where the rental occurs.

VEHICLE:

“Vehicle” means the automobile specified in the booking, including any approved substitute, along with all of its accessories, tires, tools, keys, equipment, and any accompanying vehicle documents.

PHYSICAL DAMAGE:

Refers to damage to the Vehicle caused by collision, rollover, or any impact incident. It does not cover damage resulting from theft, vandalism, fire, flood, acts of nature, or civil disturbances.

LOSS OF USE:

This is the calculated amount based on the rental rate for the period during which the Vehicle is unavailable due to repairs after damage. It is determined by multiplying the downtime by the standard rental rate.

2. FACILITATION ONLY.

ItWhip.com is a peer-to-peer vehicle-sharing platform that connects independent vehicle owners (Hosts) with renters (Guests). We are a technology platform only—we do not own, manage, inspect, or maintain the vehicles listed on our site.

Our Role:

• Trusted Marketplace: We provide a secure, user-friendly environment where Hosts and Guests can interact.

• Identity & Eligibility Verification: All users must complete driver’s license checks and other identity verifications.

• Payment Processing: We support secure transactions via trusted third-party providers such as Stripe, PayPal, and others.

• Booking & Communication Records: Our system logs all booking details and messages to promote transparency and support dispute resolution.

• Dispute Resolution Assistance: While we do not directly manage disputes, our support team is available to mediate if issues arise.

What We Do Not Do:

• We do not own the vehicles.

• We do not perform routine inspections or maintenance.

• We do not guarantee vehicle performance or availability beyond what is represented by the Host.

• We do not offer insurance directly (though we may recommend third-party providers).

This decentralized, peer-to-peer model allows Hosts to maximize their earnings and Guests to enjoy competitive, lower prices. However, it also means that the responsibility for the vehicle’s condition and performance rests primarily with the Host.

3. NO LIABILITY.

ItWhip.com is strictly an online facilitator. We assume no liability for:

• Vehicle Damage or Mechanical Issues: Any defects or malfunctions of the Vehicle.

• Theft or Vandalism: Losses arising from theft, vandalism, or natural disasters.

• Traffic Violations & Accidents: Any fines, penalties, or legal consequences that occur during the rental period.

• Personal Injuries: Injuries to you or third parties, regardless of fault.

• Financial Disputes: Issues related to unpaid fees, security deposits, or cancellations.

Disputes regarding the condition of the vehicle, the return of security deposits, or any other issues must be resolved directly between the Host and the Guest, although ItWhip.com may provide support and mediation where possible.

4. PAYMENT & DEPOSITS.

All financial transactions on ItWhip.com are handled by secure, third-party payment processors (e.g., Stripe, PayPal, Zelle, Venmo, and CashApp).

Key Points:

• Payment Processing: Upon booking, payment is processed securely. The funds are either held by ItWhip (if applicable) or transferred directly to the Host.

• Security Deposits: If required by the Host, a security deposit is held to cover potential damages or breaches. Deposits are managed by the Host and are refunded after the trip if no issues are reported.

• Trip Balance: The remaining balance for the rental is transferred to the Host, ensuring that they receive payment promptly.

• Finality of Payment: Once funds are released, they cannot be reclaimed by ItWhip except in exceptional circumstances outlined in these Terms.

5. BOOKING AGREEMENT.

When you complete a booking, you are entering into a contractual agreement that includes:

• Acceptance of the Host’s individual rental terms.

• A commitment to pay the full amount and any applicable fees.

• Agreement to abide by all pickup, return, and usage rules as defined by the Host.

Your booking confirms that you have read, understood, and accepted these Terms along with any additional agreements provided by the Host.

6. RENTAL TERMS.

This section governs the use of the Vehicle during the rental period.

Key Provisions:

• No Warranties: The Vehicle is provided “as-is” with no express or implied warranties, including fitness for a particular purpose.

• Proper Use: The Vehicle must be used in a lawful manner and in accordance with the Host’s instructions. Misuse may result in repossession.

• Return Conditions: The Vehicle must be returned in the same condition it was provided (except for normal wear and tear). All maintenance, such as checking fluid levels, must be performed as instructed.

• Host Repossession: If the Vehicle is abandoned or misused, the Host has the right to repossess it, and you will be responsible for any associated costs.

7. RESPONSIBILITY FOR DAMAGE OR LOSS.

You are fully responsible for any damage or loss incurred during the rental period.

Your Responsibilities Include:

• Damage Costs: Paying for any physical damage to the Vehicle, including the cost of repairs and loss of rental income (“Loss of Use”).

• Lost Accessories: Replacing any missing equipment or accessories.

• Administrative Costs: Covering all costs incurred by the Host or ItWhip related to damage or loss, regardless of fault.

• Reporting: Immediately reporting any accident, theft, or incident to the police, the Host, and ItWhip.

This obligation applies even if you are not found legally at fault, unless limited by applicable law.

8. LIABILITY INSURANCE.

Liability insurance is a critical component of your rental.

Insurance Requirements:

• Guest Responsibility: You must have active personal auto liability insurance or rental car insurance that covers you, the Vehicle, and third-party claims.

• Host Responsibility: Hosts must maintain an insurance policy that permits peer-to-peer rentals.

• Supplemental Coverage: In states where required, ItWhip may provide additional insurance coverage as excess to any existing policies. However, this is only applicable when mandated by law or if the Guest lacks sufficient coverage.

It is your responsibility to ensure that you have appropriate coverage before booking a rental.

9. CHARGES.

You agree to pay all charges associated with your rental, which may include:

• Rental Time: Charges based on the duration you keep the Vehicle.

• Optional Services: Fees for any extra services or add-ons you select.

• Taxes and Fees: Applicable sales, use, or other governmental taxes.

• Late or Overuse Fees: Additional fees if the Vehicle is returned late or if there is excessive mileage.

In the event of damage or breach of terms, deductions may be made from your deposit.

10. MODIFICATIONS & EXTENSIONS.

Any changes to your rental agreement must be agreed upon in writing.

• Modifications: No term of this Agreement can be altered or waived unless confirmed in writing by both ItWhip (or the Host) and you.

• Extensions: To extend the rental period, you must arrange for the Vehicle to be inspected by the Host and obtain written approval for a new return date or time.

• Unauthorized Changes: Extensions or modifications made without proper approval may be considered a breach of this Agreement, subjecting you to additional charges or penalties.

11. INSURANCE DISCLOSURE.

ItWhip.com does not provide insurance coverage directly.

• Third-Party Insurance: Both Hosts and Guests must secure their own insurance or opt for third-party rental insurance providers. We recommend providers such as Allianz Global Assistance, Bonzah, or Insure My Rental Car (by AIG).

• Claim Handling: Any insurance claims must be filed directly with your respective insurance provider.

• No Platform Coverage: ItWhip acts solely as a facilitator and is not responsible for processing or managing insurance claims.

12. REFUND POLICY.

ItWhip.com operates as a peer-to-peer vehicle-sharing platform, not a traditional rental company. As such, we offer Hosts full control over their bookings and allow them to keep 100% of their earnings. This structure benefits both sides—Guests receive lower pricing, and Hosts maximize their profit. However, it also necessitates a strict No Refund Policy, which is explained in detail below.

12.1 WHY MOST BOOKINGS ARE NON-REFUNDABLE:

Once a booking is confirmed:

• Reserved Availability: The Vehicle is immediately removed from the Host’s availability calendar.

• Direct Payout: The Host may be paid directly, often within hours, leaving little recourse for fund recovery.

• Exclusive Reservation: The time slot is reserved solely for you, preventing the Host from accepting other bookings during that period.

Because ItWhip does not hold or control the funds after they are released, we cannot reverse payments or issue refunds—even in the case of cancellations or early returns.

12.2 WHO GETS PAID AND WHY IT MATTERS:

• Direct Payments: Hosts receive payments directly without intermediary commissions.

• No Clawback: Since ItWhip does not take a percentage of the rental fee, funds cannot be “clawed back” unless a Host voluntarily issues a refund or agrees in writing prior to booking.

• Financial Finality: This direct payout model ensures Hosts maximize earnings, which in turn keeps rental costs low for Guests.

12.3 REFUNDS MAY ONLY APPLY IN THE FOLLOWING CASES:

Refunds or credits may be issued only under limited circumstances:

• Host Cancellation: If a Host cancels the booking and ItWhip still controls the funds, a refund or store credit may be provided.

• Fraud or Misconduct: If it is verified that the Host misrepresented the Vehicle or failed to deliver as promised, ItWhip will mediate and, if appropriate, process a refund from funds still held on the platform.

• Platform Error: If a technical or processing error results in a duplicate or invalid booking, corrective measures—including refunds—may be applied.

12.4 HOST-ISSUED REFUNDS:

Some Hosts may offer refunds at their discretion. For such a refund to be valid:

• The Host’s refund policy must be clearly provided in writing before you complete your booking.

• You must have documented evidence (such as a screenshot or email) confirming the refund terms (e.g., “Cancel within 24 hours for a full refund”).

• Without written pre-booking documentation, ItWhip’s No Refund Policy remains in effect.

12.5 ARIZONA LAW & REFUND DISCLOSURE:

Operating under Arizona law:

• Legal Compliance: ItWhip adheres to Arizona Revised Statutes, which permit “no refund” business models when terms are clearly disclosed before purchase.

• Disclosure: This policy is displayed before booking, and acceptance is required at checkout.

• Consumer Awareness: Guests have ample opportunity to review these terms via our FAQs and support pages.

12.6 STORE CREDIT – RARE EXCEPTIONS:

While cash refunds are generally not issued:

• Exceptions: Store credit may be provided in cases of platform errors, duplicate bookings, or verified identity fraud.

• Case-by-Case Basis: Such credits are evaluated and administered by platform administrators on an individual basis.

IMPORTANT REMINDERS:

• ItWhip is a facilitator for independent vehicle owners.

• Deposits and funds are managed by the Host.

• Refund disputes must adhere to the pre-agreed terms between the Host and Guest.

13. GUEST PROTECTIONS & PLATFORM COMMITMENT.

While our No Refund Policy is strict, ItWhip.com is dedicated to protecting Guests against fraudulent or poor service experiences.

Protections Include:

• Intervention in No-Show Situations: If a Host fails to deliver the Vehicle as agreed, our support team will intervene to mediate a solution.

• Misrepresentation Safeguards: If the Vehicle is significantly misrepresented (e.g., condition, model, or location), we will work to secure a refund or alternative compensation.

• Fraud Prevention: Through rigorous identity checks and monitoring, we aim to prevent scams and ensure that only verified users participate.

• Dispute Resolution: In cases of dispute, ItWhip reviews all communication logs, booking details, and activity records to assist in achieving a fair resolution.

• Temporary Fund Holding: When necessary, funds may be held temporarily until the Guest confirms the Vehicle’s condition or delivery.

Our goal is to maintain a safe, fair, and trusted environment where Guests feel confident in every booking.

14. HOST CANCELLATIONS & DISPUTES.

If a Host cancels your booking:

• Full Refund Eligibility: If the payment is still held by ItWhip, you may receive a full refund or store credit. If the Host has already received payment, ItWhip will assist in mediating a resolution, though the Host ultimately bears responsibility.

• Dispute Process: Both parties are encouraged to resolve issues amicably through direct communication. If this fails, ItWhip’s support team will review booking records, messages, and other evidence to facilitate a fair outcome.

This process is designed to balance Host autonomy with Guest protection.

15. FRAUD & SCAM PROTECTION.

At ItWhip.com, we are committed to maintaining platform integrity and preventing fraud.

Our Multi-Layered Approach Includes:

15.1 VERIFICATION & PLATFORM SECURITY

• Identity Verification: All users must submit valid driver’s license information and other identifying documents before booking.

• Secure Payment Processing: Payments are processed through reputable third-party gateways, reducing the risk of fraudulent transactions.

• Device & IP Monitoring: We actively monitor access patterns and use technology to detect and flag suspicious behavior.

• Message Logging: All communications within the platform are logged to ensure accountability and to aid in investigations if needed.

15.2 PROHIBITED CONDUCT.

The following actions are strictly forbidden:

• Listing vehicles that the Host does not legally own or have the right to rent.

• Using stolen or fraudulent payment methods.

• Impersonating another individual or falsifying identification.

• Intentionally misrepresenting a Vehicle’s condition, location, or availability.

• Attempting to bypass our platform by arranging off-site transactions.

Violators of these rules risk immediate suspension or permanent removal from the platform.

15.3 IF YOU SUSPECT A SCAM.

• Stop Communication: Cease any off-platform interactions immediately.

• Document Evidence: Save screenshots or records of any suspicious communications.

• Report Immediately: Use the in-platform reporting tools or email support@itwhip.com to alert our Trust & Safety team.

If fraud is confirmed, we will take swift action, including suspending the offending account, assisting law enforcement, and working with payment processors to freeze or reverse unauthorized charges.

15.4 FINANCIAL SAFETY LIMITATIONS.

ItWhip does not control Host funds once they have been transferred. We are not liable for financial losses resulting from off-platform transactions or arrangements. Always transact exclusively through our secure system.

16. SUMMARY.

• Finality: All bookings are final. Refunds are only available under strictly limited circumstances.

• Host Earnings: Hosts receive 100% of their earnings, ensuring lower prices for Guests.

• Dispute Resolution: ItWhip supports, but does not guarantee, dispute resolutions—final responsibility rests with the Host and Guest.

• Deposits: Security deposits are managed by the Host.

• Fraud Prevention: Robust mechanisms are in place to protect against scams and fraudulent behavior.

• Communication: All parties are expected to interact solely through the ItWhip platform to ensure transparency and security.

• Overage fee per additional mile.

• Security deposit amount.

These limits are visible to the renter before booking. Any time or mileage beyond the agreed terms is automatically billed based on the listing’s settings.

Sellers are protected from unauthorized use and overuse via platform monitoring, digital check-in/out, and documentation.

7. HOW IS THE SALE HANDLED IF THE BUYER DECIDES TO PURCHASE THE VEHICLE?

If a buyer proceeds with the purchase:

• Payment may be completed via cash, cashier’s check, or outside financing.

8. WHAT IF MULTIPLE BUYERS EXPRESS INTEREST IN THE SAME VEHICLE?

The ItWhip platform permits multiple Rent-To-Buy bookings. However, only the first approved renter to finalize a purchase will proceed with ownership.

If another buyer finalizes the purchase before a later renter’s booking begins:

• The listing will be marked as “Sold.”

• All pending bookings will be automatically canceled and refunded in full.

This ensures a fair process for all interested buyers while protecting your time and avoiding unnecessary handoffs.

9. CAN RENTERS EXTEND THEIR TIME OR MILEAGE DURING A RENTAL?

Yes—if arranged in advance. Renters may message the seller through the platform to request:

• Additional rental hours or days.

• Additional mileage at the agreed per-mile rate.

Unapproved overages may result in late fees or loss of deposit. Sellers maintain the right to approve or decline any changes, and the platform tracks all use and time.

The rental portion of the transaction must take place on ItWhip to ensure proper insurance, coverage, and payment tracking.

Off-platform rentals are not supported and void all protections.

The sale portion (title transfer and payment) is handled directly between the seller and buyer once a purchase decision is made.

13. WHAT PROTECTIONS ARE IN PLACE FOR PRIVATE SELLERS?

ItWhip provides multiple safeguards for all private vehicle owners using Rent-To-Buy:

• Insurance-backed rentals (no uninsured drivers).

• Strict renter qualification (age, license, identity verified).

• Security deposit enforcement.

• Pre-paid rental fees.

• Mileage and time monitoring.

• Support team and digital logs to resolve disputes quickly.

You remain in full control of your vehicle and have access to a platform that turns buyer interest into immediate, secure value.

14. HOW DO I ENROLL MY VEHICLE IN THE RENT-TO-BUY PROGRAM?

To list your car with Rent-To-Buy on ItWhip:

1. Visit: List Your Car.

2. Select Rent-To-Buy under listing preferences.

3. Add rental pricing, mileage terms, and sale price.

4. Upload verification documents (VIN, title, ID).

5. Go live and accept bookings directly through your dashboard.

Your vehicle stays in your possession. You control pricing, scheduling, and final buyer approval.
