1. DEFINITIONS.
AGREEMENT: This Agreement includes all terms and conditions on this document, any attached addenda, and any materials provided at the time of rental. It governs all interactions between Hosts, Guests, and ItWhip.com.
YOU / YOUR: “You” or “Your” refers to the individual identified as the renter in your booking, any additional person who signs the Agreement, any authorized driver, and any party designated to receive charges at your direction. Every person falling under “You” is jointly and severally bound by these Terms.
WE / OUR / US: This term refers to ItWhip.com as the online facilitation platform and, where applicable, the Host who manages the rental. ItWhip.com operates as a technology provider connecting Hosts and Guests.
AUTHORIZED DRIVER: An Authorized Driver is any individual approved by the Host or ItWhip, including you (the Renter) and any additional driver with a valid driver’s license who meets the minimum age and legal requirements of the state where the rental occurs.
VEHICLE: “Vehicle” means the automobile specified in the booking, including any approved substitute, along with all of its accessories, tires, tools, keys, equipment, and any accompanying vehicle documents.
HOST: “Host” means the individual or entity who lists a vehicle on ItWhip.com, certifies legal ownership or authorization to rent that vehicle, and agrees to all platform policies while remaining fully responsible for the vehicle’s condition, accuracy of listing details, and compliance with applicable laws.
GUEST: “Guest” (or “Renter”) means the verified user who books and operates a Host’s vehicle through ItWhip.com, accepts all rental terms, and assumes financial and legal responsibility for the vehicle during the rental period.
RENT‑TO‑BUY: “Rent‑to‑Buy” refers to the optional program that allows a Guest to rent a vehicle for a short term with the option to apply 100 percent of the rental payments toward the eventual purchase price, subject to the specific Rent‑to‑Buy Program Terms & Conditions.
REFUND: “Refund” means any return of funds to a Guest under the limited circumstances outlined in the Refund Policy and Cancellation Penalties section; all other bookings are final and non‑refundable unless expressly stated by the Host.
DISPUTE: “Dispute” refers to any disagreement or claim arising between a Host and a Guest (or between a user and ItWhip) regarding a booking, payment, damage, or policy interpretation, which must follow the platform’s Dispute Resolution procedure.
100 % EARNING FOR HOST: “100 percent earning for Host” indicates that Hosts retain the full rental fee collected for their vehicle, less only any third‑party processing or insurance costs, with no commission taken by ItWhip.com.
LIST YOUR CAR: “List Your Car” is the Host‑facing action of creating a vehicle listing on ItWhip.com, including uploading photos, setting pricing, and agreeing to all Host Responsibilities and platform policies.
RENT A CAR: “Rent a Car” is the Guest‑facing action of booking a listed vehicle through ItWhip.com’s reservation system, thereby entering a binding Booking Agreement with the Host under these Terms & Conditions.
PHYSICAL DAMAGE: Refers to damage to the Vehicle caused by collision, rollover, or any impact incident. It does not cover damage resulting from theft, vandalism, fire, flood, acts of nature, or civil disturbances.
LOSS OF USE: This is the calculated amount based on the rental rate for the period during which the Vehicle is unavailable due to repairs after damage. It is determined by multiplying the downtime by the standard rental rate.
2. PLATFORM STRUCTURE & LEGAL ROLE.
ItWhip.com (“ItWhip,” “We,” or “Our Platform”) provides a secure peer-to-peer vehicle rental marketplace connecting independent Hosts with verified Guests. ItWhip is not a vehicle owner, operator, or rental agency and does not control the condition, legality, or performance of any vehicle listed on the platform. Users acknowledge that ItWhip acts solely as a facilitator and service provider.
3. ACCOUNT MANAGEMENT & USER VERIFICATION.
All users must create a verified profile using legal identification and agree to abide by platform terms. Hosts and Guests are independently responsible for all activity associated with their account.
- Hosts must list only vehicles they own or are authorized to offer.
- Guests must maintain an active driver’s license and meet age and insurance requirements.
Accounts may be suspended or terminated without notice for fraudulent behavior, repeated cancellations, safety violations, or policy breaches.
4. FACILITATION ONLY.
ItWhip.com is a peer-to-peer vehicle-sharing platform that connects independent vehicle owners (Hosts) with renters (Guests). We are a technology platform only—we do not own, manage, inspect, or maintain the vehicles listed on our site.
OUR ROLE:
- Trusted Marketplace: We provide a secure, user-friendly environment where Hosts and Guests can interact.
- Identity & Eligibility Verification: All users must complete driver’s license checks and other identity verifications.
- Payment Processing: We support secure transactions via trusted third-party providers such as Stripe, PayPal, and others.
- Booking & Communication Records: Our system logs all booking details and messages to promote transparency and support dispute resolution.
- Dispute Resolution Assistance: While we do not directly manage disputes, our support team is available to mediate if issues arise.
WHAT WE DO NOT DO:
- We do not own the vehicles.
- We do not perform routine inspections or maintenance.
- We do not guarantee vehicle performance or availability beyond what is represented by the Host.
- We do not offer insurance directly; however, we provide third-party rental insurance coverage through our approved partners.
5. NO LIABILITY.
ItWhip.com is strictly an online facilitator. We assume no liability for:
- Vehicle Damage or Mechanical Issues: Any defects or malfunctions of the Vehicle.
- Theft or Vandalism: Losses arising from theft, vandalism, or natural disasters.
- Traffic Violations & Accidents: Any fines, penalties, or legal consequences that occur during the rental period.
- Personal Injuries: Injuries to you or third parties, regardless of fault.
- Financial Disputes: Issues related to unpaid fees, security deposits, or cancellations.
6. PAYMENT & DEPOSITS.
All financial transactions on ItWhip.com are handled by secure, third-party payment processors (e.g., Stripe, PayPal, Zelle, Venmo, and CashApp).
KEY POINTS:
- Payment Processing: Upon booking, payment is processed securely. The funds are either held by ItWhip (if applicable) or transferred directly to the Host.
- Security Deposits: If required by the Host, a security deposit is held to cover potential damages or breaches. Deposits are managed by the Host and are refunded after the trip if no issues are reported.
- Trip Balance: The remaining balance for the rental is transferred to the Host, ensuring that they receive payment promptly.
- Finality of Payment: Once funds are released, they cannot be reclaimed by ItWhip except in exceptional circumstances outlined in these Terms.
7. BOOKING AGREEMENT.
When you complete a booking, you are entering into a contractual agreement that includes:
- Acceptance of the Host’s individual rental terms.
- A commitment to pay the full amount and any applicable fees.
- Agreement to abide by all pickup, return, and usage rules as defined by the Host.
Your booking confirms that you have read, understood, and accepted these Terms along with any additional agreements provided by the Host.
8. HOST RESPONSIBILITIES.
Hosts are required to:
- OWNERSHIP AND AUTHORITY: List only vehicles they legally own or have authorization to rent.
- VEHICLE CONDITION: Ensure vehicles are safe, clean, operable, and legally compliant.
- LEGAL COMPLIANCE: Maintain current registration, valid insurance permitting peer-to-peer rentals, and routine maintenance.
- ACCURATE LISTINGS: Provide truthful descriptions and photos of their vehicles.
- TIMELY DELIVERY: Deliver the vehicle as listed, on time, and ready for the rental period.
9. GUEST RESPONSIBILITIES.
Guests are required to:
- LICENSE AND AGE: Possess a valid driver’s license and meet the minimum age requirement of 21 years.
- INSURANCE: Have active personal auto liability insurance or purchase coverage through ItWhip’s partners.
- VEHICLE USE: Operate the vehicle responsibly, adhere to all traffic laws, and avoid prohibited uses.
- REPORTING ISSUES: Immediately report any mechanical concerns or accidents to the Host and ItWhip.
- RETURN CONDITION: Return the vehicle in the same condition it was received, with the same fuel level and cleanliness.
10. MECHANICAL ISSUES & LIABILITY.
Hosts are solely responsible for ensuring the mechanical safety and legality of the vehicle prior to any rental. Guests must immediately report any mechanical concerns. If a mechanical breakdown occurs not caused by Guest misuse or negligence, the Host bears responsibility for retrieval, repair, or refund, unless otherwise agreed.
11. RENTAL TERMS.
This section governs the use of the Vehicle during the rental period.
KEY PROVISIONS:
- No Warranties: The Vehicle is provided “as-is” with no express or implied warranties, including fitness for a particular purpose.
- Proper Use: The Vehicle must be used in a lawful manner and in accordance with the Host’s instructions. Misuse may result in repossession.
- Return Conditions: The Vehicle must be returned in the same condition it was provided (except for normal wear and tear). All maintenance, such as checking fluid levels, must be performed as instructed.
- Host Repossession: If the Vehicle is abandoned or misused, the Host has the right to repossess it, and you will be responsible for any associated costs.
12. RESPONSIBILITY FOR DAMAGE OR LOSS.
You are fully responsible for any damage or loss incurred during the rental period.
YOUR RESPONSIBILITIES INCLUDE:
- Damage Costs: Paying for any physical damage to the Vehicle, including the cost of repairs and loss of rental income (“Loss of Use”).
- Lost Accessories: Replacing any missing equipment or accessories.
- Administrative Costs: Covering all costs incurred by the Host or ItWhip related to damage or loss, regardless of fault.
- Reporting: Immediately reporting any accident, theft, or incident to the police, the Host, and ItWhip.
This obligation applies even if you are not found legally at fault, unless limited by applicable law.
13. LIABILITY INSURANCE.
Liability insurance is a critical component of your rental.
INSURANCE REQUIREMENTS:
- Guest Responsibility: You must have active personal auto liability insurance or rental car insurance that covers you, the Vehicle, and third-party claims.
- Host Responsibility: Hosts must maintain an insurance policy that permits peer-to-peer rentals.
- Supplemental Coverage: In states where required, ItWhip may provide additional insurance coverage as excess to any existing policies. However, this is only applicable when mandated by law or if the Guest lacks sufficient coverage.
It is your responsibility to ensure that you have appropriate coverage before booking a rental.
14. CHARGES.
You agree to pay all charges associated with your rental, which may include:
- Rental Time: Charges based on the duration you keep the Vehicle.
- Optional Services: Fees for any extra services or add-ons you select.
- Taxes and Fees: Applicable sales, use, or other governmental taxes.
- Late or Overuse Fees: Additional fees if the Vehicle is returned late or if there is excessive mileage.
In the event of damage or breach of terms, deductions may be made from your deposit.
15. MODIFICATIONS & EXTENSIONS.
Any changes to your rental agreement must be agreed upon in writing.
- Modifications: No term of this Agreement can be altered or waived unless confirmed in writing by both ItWhip (or the Host) and you.
- Extensions: To extend the rental period, you must arrange for the Vehicle to be inspected by the Host and obtain written approval for a new return date or time.
- Unauthorized Changes: Extensions or modifications made without proper approval may be considered a breach of this Agreement, subjecting you to additional charges or penalties.
16. INSURANCE DISCLOSURE.
ItWhip.com provides third-party rental insurance coverage through its approved partners.
- Third-Party Insurance: Both Hosts and Guests are covered by rental insurance provided via our approved third-party providers. We work with providers such as Allianz Global Assistance, Bonzah, and Insure My Rental Car (by AIG) to ensure coverage.
- Claim Handling: All insurance claims must be filed through the third-party provider. ItWhip will assist in coordinating the claim process.
- Platform Facilitation: ItWhip acts as a facilitator and ensures that the rental insurance is in place, but is not responsible for determining liability in insurance claims.
17. REFUND POLICY.
ItWhip.com operates as a peer-to-peer vehicle-sharing platform, not a traditional rental company. As such, we offer Hosts full control over their bookings and allow them to keep 100% of their earnings. This structure benefits both sides—Guests receive lower pricing, and Hosts maximize their profit. However, it also necessitates a strict No Refund Policy, which is explained in detail below.
18. CANCELLATION PENALTIES & REFUND CONDITIONS.
ItWhip enforces a strict no-refund policy, except in platform-verified cases including:
- Duplicate Bookings caused by technical error.
- Host No-Show or Misrepresentation, provided evidence is submitted within 24 hours.
- Platform Cancellation due to account violations.
ItWhip does not issue refunds for Guest cancellations unless a Host has published a written policy stating otherwise. All bookings are final upon Host acceptance and payment processing.
19. GUEST PROTECTIONS & PLATFORM COMMITMENT.
While our No Refund Policy is strict, ItWhip.com is dedicated to protecting Guests against fraudulent or poor service experiences.
- Intervention in No-Show Situations.
- Misrepresentation Safeguards.
- Fraud Prevention via identity checks and tracking.
- Dispute Resolution with message log review.
- Temporary Fund Holding when required.
Our goal is to maintain a safe, fair, and trusted environment where Guests feel confident in every booking.
20. INSURANCE ROLES & CLAIM RESPONSIBILITIES.
It is mandatory for all vehicles on ItWhip to be covered by valid insurance that permits peer-to-peer rental activity. Hosts and Guests are each responsible for their side of compliance:
- Guests must have valid liability coverage or obtain coverage through ItWhip’s approved partners.
- Hosts must ensure their vehicles are legally insured for rentals and provide proof when requested.
- Primary Insurance: The Guest’s insurance is considered primary during an active trip, unless otherwise defined by purchased coverage or legal jurisdiction.
In case of a claim or incident, ItWhip will coordinate evidence gathering, but legal liability will be determined by the relevant insurance carrier, not the platform.
21. INDEMNIFICATION & LIABILITY LIMITATION.
By using ItWhip, all users agree to the following:
- You shall indemnify, defend, and hold harmless ItWhip and its owners, staff, agents, or affiliates from any and all claims, liabilities, losses, damages, or legal fees resulting from your use of the platform.
- ItWhip is not liable for personal injury, property damage, or financial loss stemming from any vehicle listed, rented, or operated through the platform.
- Users accept full responsibility for their own conduct and compliance with laws while using any listed vehicle.
22. DISPUTE RESOLUTION & LEGAL VENUE.
In the event of a booking dispute or platform disagreement:
- Initial Resolution: All users must first attempt to resolve disputes directly using ItWhip’s in-platform messaging.
- Escalation: If unresolved, either party may submit a formal support request to ItWhip Support for investigation.
- Final Decision: ItWhip will review submitted documentation and message logs before issuing a mediation result.
- Legal Recourse: If no resolution is reached, all legal claims must be filed in the state courts of Arizona, specifically Maricopa County, unless arbitration is mutually agreed upon in writing.
23. TERMINATION & VIOLATIONS.
ItWhip reserves the right to remove listings, withhold payments, or suspend any user account for:
- Repeated cancellation patterns.
- Insurance or registration fraud.
- Vehicle misrepresentation.
- Communication abuse or harassment.
- Soliciting off-platform payments or rentals.
These protections ensure trust and integrity for all platform participants.
24. FORCE MAJEURE.
Neither party shall be liable for failure to perform obligations under this Agreement due to force majeure events beyond their control, including acts of God, pandemic, war, shutdowns, or government restrictions.

RENT-TO-BUY PROGRAM TERMS & CONDITIONS
These Terms & Conditions ('Terms') form a legally binding agreement ('Agreement') between you ('Renter,' 'Guest,' or 'You') and ItWhip.com ('We,' 'Us,' or 'Our')—and, where applicable, the independent vehicle owner ('Host'). By participating in our Rent-To-Buy program, you agree to all the terms set forth herein. Please read these Terms carefully before engaging in any Rent-To-Buy transaction.
- DEFINITIONS. This Agreement includes all terms and conditions in this document, any attached addenda, and any materials provided at the time of rental. It governs all interactions between Hosts, Buyers, and ItWhip.com.
- RENT-TO-BUY PROGRAM OVERVIEW. The Rent-To-Buy program allows prospective buyers to book a short-term, fully insured rental of a vehicle prior to making a purchase decision. If the buyer decides to purchase, 100% of the rental payment is credited toward the final sale price. This program is designed primarily for private owners of high-value, exotic, luxury, and high-performance vehicles. It addresses challenges such as rapid depreciation, unqualified inquiries, and the risks associated with traditional test drives. Through the program, the vehicle is driven only by pre-screened, age-verified renters; full commercial insurance is provided via approved third-party rental insurance providers; strict mileage and rental duration limits are enforced; payment is received for every rental; and the Host retains possession of the vehicle until the sale is finalized.
- RENT-TO-BUY VS. TRADITIONAL TEST DRIVE. Traditional test drives are brief, typically supervised, and offer minimal real-world experience. In contrast, Rent-To-Buy offers extended, independent usage (hourly or daily rentals) with full rental insurance coverage throughout the rental period, and access limited to pre-qualified, verified renters. Rental payments contribute directly to the purchase price if a sale occurs.
- BUYER PURCHASE OBLIGATION. Participation in the Rent-To-Buy program does not obligate the buyer to complete a purchase. If the buyer decides not to proceed, the rental is treated as a standard, non-refundable transaction. In such cases, the Host retains the rental payment, and the vehicle’s condition remains protected under the program’s guidelines.
- RENT-TO-BUY PARTICIPANT ELIGIBILITY. All participants in the Rent-To-Buy program must be at least 25 years of age, possess a valid U.S. driver’s license, pass identity verification checks, provide a refundable security deposit, and secure approved rental insurance through personal coverage or via ItWhip’s third-party partners.
- INSURANCE COVERAGE. All Rent-To-Buy rentals are fully insured through reputable third-party providers. The insurance policy covers liability, collision, and theft, ensuring protection for both the Buyer and the Host during the rental period. The renter’s insurance is considered primary unless additional coverage is purchased through the platform. Hosts must maintain an insurance policy that permits peer-to-peer rentals. ItWhip facilitates access to third-party rental insurance and does provide such insurance via our approved partners.
- RENTAL TERMS & LIMITS. Each Rent-To-Buy listing specifies the hourly or daily rental rate, a mileage cap (e.g., 30 miles per hour or 100 miles per day), fees for additional mileage or extended rental time, the required security deposit amount, and available rental duration options. Any use beyond the agreed limits will incur additional charges.
- PURCHASE PROCESS. If the buyer decides to purchase the vehicle after the Rent-To-Buy rental, the rental payment is fully credited toward the final sale price. The sale is conducted directly between the Host and the buyer through a separate, private transaction (including bill of sale, title transfer, etc.). Payment for the sale may be made via cash, cashier’s check, or external financing. ItWhip does not interfere with the final sale process, nor does it take a commission on the sale.
- MULTIPLE INTEREST & CANCELLATIONS. While multiple Rent-To-Buy bookings may be made, only the first approved buyer to finalize the purchase is eligible to buy the vehicle. If a subsequent booking is made after the vehicle is sold, those bookings will be automatically canceled and refunded in full. If a Guest cancels their booking before the rental period begins, no refund will be issued, and the rental payment is forfeited.
- EXTENSIONS AND MODIFICATIONS. Any modifications or extensions to the rental period must be arranged in advance with the Host. Extensions in time or mileage require written approval from the Host. Unauthorized extensions may result in additional fees or forfeiture of the security deposit.
- FORCE MAJEURE. Neither party shall be liable for any failure to perform their obligations under this Agreement due to force majeure events beyond their control, including acts of God, pandemics, natural disasters, war, or government restrictions.
- HOST RESPONSIBILITIES. Hosts are required to list only vehicles they legally own or have authorization to rent; ensure vehicles are safe, clean, operable, and legally compliant; maintain current registration and valid insurance permitting peer-to-peer rentals; provide truthful descriptions and photos of their vehicles; and deliver the vehicle as listed, on time, and ready for the rental period.
- GUEST RESPONSIBILITIES. Buyers are required to possess a valid driver’s license and meet the minimum age requirement of 21 years; have active personal auto liability insurance or purchase coverage through ItWhip’s approved third-party partners; operate the vehicle responsibly, adhere to all traffic laws, and avoid prohibited uses; immediately report any mechanical concerns or accidents to the Host and ItWhip; and return the vehicle in the same condition it was received.
- MECHANICAL ISSUES AND LIABILITY. Hosts are solely responsible for ensuring the mechanical safety and legality of the vehicle prior to any rental. Buyers must immediately report any mechanical issues. If a mechanical breakdown occurs that is not caused by Buyer misuse or negligence, the Host shall be responsible for retrieval, repair, or refund, unless otherwise agreed.
- INSURANCE & COVERAGE. ItWhip.com provides access to third-party rental insurance for all Rent-To-Buy transactions. Buyers must obtain valid auto liability or rental car insurance that covers the vehicle and third-party claims. Hosts must maintain insurance policies that permit peer-to-peer rentals. In states where required, additional insurance coverage may be provided via our approved partners. The renter’s insurance is considered primary unless supplemental coverage is purchased.
